ANATEL: 6 dB Bandwidth Exemption to End on October 6, 2026

ANATEL Act No. 14158 introduces updated bandwidth and spurious emission requirements for equipment under item 10.3.4 following the transition period established by Act No. 4746.

ANATEL published Act No. 14158 on October 1, 2025, introducing changes to the technical requirements for equipment using Spread Spectrum Technology or other Digital Modulation Technologies operating in the 902–907.5 MHz, 915–928 MHz, 2400–2483.5 MHz, and 5725–5850 MHz bands and classified under item 10.3.4.

The Act repealed the exemption under item 10.3.4.4, which had allowed certain equipment to be exempt from the 6 dB bandwidth requirement established in item 10.3.1. The spurious emission requirement for equipment evaluated under item 10.3.4 was also updated from 20 dB to 30 dB.

Act No. 4746 established a transition period for these changes. Until October 5, 2026, equipment evaluated under item 10.3.4 may continue to use the existing exemption, meaning that the 6 dB bandwidth requirement does not apply and spurious emissions may remain at the 20 dB level.

Starting October 6, 2026, the exemption under item 10.3.4.4 is scheduled to no longer apply. Equipment under item 10.3.4 submitted for new certification or as standard applications after this date must comply with item 10.3.1, including a minimum 6 dB bandwidth of 500 kHz. Spurious emissions must also meet the 30 dBc requirement specified in item 10.6.

The new requirements apply only to new certifications, devices not yet approved, and standard applications submitted after October 6, 2026. Devices approved before this date, including their upcoming renewals, remain valid and are not affected.

The change particularly affects technologies such as LoRa, which previously qualified under item 10.3.4 but cannot meet the 500 kHz bandwidth threshold.
