MINCOM Implements Resolutions 1/2026 and 2/2026
Cuba’s Ministry of Communications (MINCOM) has enacted Resolutions 1/2026 and 2/2026, superseding the regulatory framework established in 2015, 2019, and 2020. The updated legislation distinguishes between imports for personal use and equipment intended for commercial or enterprise applications.
Devices imported for resale, commercialization, or integration into local manufacturing operations must obtain both Technical Authorization and a Homologation Certificate. These requirements apply to all products listed in Annex I, including radar apparatus and radio broadcasting receivers, and are mandatory for market access in Cuba.
For test samples, an application for Temporary Technical Authorization must be submitted at least 30 days before the samples arrive. The temporary permit remains valid for up to three months during the testing phase. Local laboratory testing is the standard requirement.
Article 47 permits the acceptance of foreign test reports where equipment specifications exceed local testing capabilities, specifically for radar systems and devices operating above 24 GHz. In these cases, the General Directorate of Communications may accept certification documentation from internationally recognized laboratories.
Applications are submitted to the General Directorate of Communications. After testing is completed and the applicable fees are paid, the Homologation Certificate is issued within 10 business days. Certificates are valid for five years.
If the device remains unchanged, a renewal application must be submitted at least 30 days before the current certificate expires. Importation without a valid certificate is not permitted, including when a renewal application is pending. Certificates issued before the enactment of the new regulations remain valid until their originally stated expiration date.
