Putting products on the market in UK after Brexit

The Brexit is finally there and the impact on any manufacturer intending to sell products on the UK markets is starting to cast its shadows ahead.

Starting with January, 1st 2021 new rules apply for the conformity assessment of radio products placed on the market in England, Wales and Scotland. Any product covered by legislation requiring the UKCA mark, requiring a mandatory third-party assessment or conformity assessment being carried out by a UK Notified Body in the past will need to use the new UKCA mark. Fortunately, products already in stock are exempted from this regulations and may be sold showing the CE mark only.

The technical examination certificate issued in the past by a UK Notified Body will cease its validity by January 1st 2021. This not only affects the conformity of your products with the regulations in the UK but also with the Radio Equipment Directive. All of those “old” TEC’s must be transferred to a conformity assessment body recognized by the UK government AND to a Notified Body located in the European Union.

An authorized representative located within the European Union will no longer be recognized by Great Britain after January 1st 2021 as well and you will have to choose an authorized representative or responsible person in the UK. The product marking must show the company details, including name and contact address, for this responsible as well.

And finally, the declaration of conformity must be changed to declare conformance to the UK technical standards once those are implemented.
