Draft Circular replacing Circular 01/2021/TT-BTTTT

The Vietnamese Ministry of Information and Communications (MIC) has published a Draft Circular regulating products subject to mandatory Type Approval Certification and Declaration of Conformity. This Circular will replace Circulars 01/2021/TT-BTTTT and 11/2020/TT-BTTTT.

Key Changes:

• Updated Standards:

  • QCVN 128:2021/BTTTT: RF standard for 5G base stations

  • QCVN 127:2021/BTTTT: RF standard for 5G SA (mandatory from July 1, 2022)

  • QCVN 129:2021/BTTTT: RF standard for 5G NSA (mandatory from July 1, 2022)

  • QCVN 124:2021/BTTTT: RF standard for Vehicle Radar 76-77 GHz (mandatory from July 1, 2022)

  • QCVN 123:2021/BTTTT: RF standard for SRD 40-246 GHz (mandatory from July 1, 2022)

  • QCVN 65:2021/BTTTT: RF standard for WLAN 5.0 GHz devices (applicable from May 1, 2022, mandatory from July 1, 2023)

  • QCVN 22:2021/BTTTT: Safety standard for ICT products (importers must comply independently as this standard is not mandatory according to Annexes 1 and 2)

• Items Removed from Mandatory List:

  • 5.8 GHz equipment for transport applications

  • Marine VHF devices

  • Inmarsat F77 devices

  • "Other devices" category

• Products Moved from Annex 1 (mandatory Type Approval Certification and Declaration of Conformity) to Annex 2 (Declaration of Conformity only):

  • 76-77 GHz vehicle radars

  • SRD devices operating in frequency bands: 13,553-13,567 MHz, 26,957-27,283 MHz, 40.66-40.7 MHz, 5725-5850 MHz, 24.00-24.25 GHz, 61.0-61.5 GHz, 122-123 GHz, 244-246 GHz

  • 13.56 MHz RFID

  • Certain land mobile radio equipment

The Circular is expected to take effect on July 1, 2022. Local testing laboratories will be able to test products according to new standards starting May/June 2022. After official publication, MIC will provide instructions for Type Approval Certification and Declaration of Conformity in cases where local laboratories cannot perform certain standard tests.
