News for United Kingdom

  • Update Transition Period

On 24 August 2021, the British Information Commissioner’s Office published the following news on its website

“Businesses are encouraged to be ready for full implementation of the new UK regime as soon as possible.
However, to allow businesses time to adjust, CE marked goods in scope of this guidance that meet EU requirements (where these match UK requirements) can continue to be placed on the GB market until 1 January 2023 where EU and UK requirements remain the same. This includes goods which have been assessed by an EU recognised notified body.

The UKCA mark must be used for placing goods on the GB market from 1 January 2023.”

  • Ofcom consults on a new regulation for short range radar devices

Today, the UK's communications regulator published proposals to amend the regulations concerning the use of short-range radar equipment for vehicular use. (For example: blind spot radars, collision radars and other driving assistance equipment)

The mentioned amendments refer to the Wireless Telegraphy (Automotive Short-Range radar) Regulations 2013.

These regulations indicate that certain SRRs in vehicles can be used in the 24 GHz band without the necessity of a spectrum license. They are proposing a minor amendment so the license exemptions continue to apply in the UK after the end of the transition period in the Withdrawal Agreement between the UK and the European Union on 31th December 2020.

Responses to this consultation are welcome by 14th of December 2020

  • Putting products on the market in UK after Brexit

The Brexit is finally there and the impact on any manufacturer intending to sell products on the UK markets is starting to cast its shadows ahead.

Starting with January, 1st 2021 new rules apply for the conformity assessment of radio products placed on the market in England, Wales and Scotland. Any product covered by legislation requiring the UKCA mark, requiring a mandatory third-party assessment or conformity assessment being carried out by a UK Notified Body in the past will need to use the new UKCA mark. Fortunately, products already in stock are exempted from this regulations and may be sold showing the CE mark only.

The technical examination certificate issued in the past by a UK Notified Body will cease its validity by January 1st 2021. This not only affects the conformity of your products with the regulations in the UK but also with the Radio Equipment Directive. All of those “old” TEC’s must be transferred to a conformity assessment body recognized by the UK government AND to a Notified Body located in the European Union.

An authorized representative located within the European Union will no longer be recognized by Great Britain after January 1st 2021 as well and you will have to choose an authorized representative or responsible person in the UK. The product marking must show the company details, including name and contact address, for this responsible as well.

And finally, the declaration of conformity must be changed to declare conformance to the UK technical standards once those are implemented.

IB-Lenhardt AG is fully supporting you during and after this transition phase with all necessary services to ensure the ongoing conformance of your products with the applicable rules. With our strong network of cooperation partners we will support the transfer of your Technical Examination Certificates to either an assessment body in the UK, a Notified Body in the EU or both.
