Anatel Opens Public Consultations No. 41 and No. 42
On September 25, 2026, the Brazilian National Telecommunications Agency (Anatel) launched a 70-day public consultation process regarding the use of the 6 GHz band for outdoor Wi-Fi applications, including Wi-Fi 7.
The proposed framework addresses outdoor connectivity while introducing mandatory automated frequency coordination to support spectrum efficiency and protect incumbent radio services from harmful interference.
The regulatory framework comprises two proposals:
1. Public Consultation No. 41/2026
Public Consultation No. 41/2026 focuses on the certification of Standard Power Wi-Fi equipment and Fixed Client Devices. Key provisions include:
Technical Standards: Adoption of Wi-Fi Alliance specifications for AFC device compliance and interfaces
Operational Limits: Maximum EIRP of 36 dBm for access points and fixed client devices, subject to specific outdoor elevation limits and authorization by an AFC System
Security and Geolocation: Secure HTTPS communication using TLS 1.2 or higher, firmware protection, and high-accuracy geolocation with a 95% confidence level using the SIRGAS2000 reference system
Testing: Conformity verification using automated AFC Test Tools and spectrum analysis to support protection of incumbent services
2. Public Consultation No. 42/2026
Public Consultation No. 42/2026 establishes requirements for Automated Frequency Coordination (AFC) Systems. Key provisions include:
System Functionality: AFC Systems must use Anatel’s Technical and Administrative Database (BDTA) to determine available frequencies and permitted power levels, applying an I/N criterion of -6 dB to protect existing radiocommunication systems
Operator Requirements: Systems must be hosted on servers located in Brazil, comply with the General Data Protection Law (LGPD), and complete a three-phase registration process consisting of application, testing/evaluation, and registration
Infrastructure Sharing: The proposed model supports Neutral Outdoor Wi-Fi Infrastructure, allowing multiple providers and sectors, including IoT, industry, and utilities, to share access points and connectivity under non-discriminatory technical conditions
Interested stakeholders may submit contributions through the Participa Anatel system until December 4, 2026.
