The process for CE marking includes the following steps:

  • Identify applicable EU legislation, such as the Radio Equipment Directive (RED), Electromagnetic Compatibility Directive (EMC), or Low Voltage Directive (LVD)

  • A smartphone marketed in the EU must carry the CE mark, confirming compliance with EMC, radiofrequency exposure limits, and electrical safety standards.

  • A toy sold within the EU must meet safety requirements outlined in the Toy Safety Directive. In both cases, technical documentation and a Declaration of Conformity must be available to authorities upon request.

  • Test equipment used in laboratories may also require CE marking and supporting evidence, particularly if it is intended for commercial distribution.

Legal Relevance and Market Access

CE marking is legally required for market access within the EEA and is binding for manufacturers, importers, and distributors. Key legal implications include:

  • Legal responsibility: The CE mark is a self-declaration of compliance with EU law.

  • Market access: Products without a CE mark cannot be legally sold within the EEA.
